Writ Petition, filed under Article 226 of the Constitution of India, praying this court to issue a Writ of Mandamus directing the Respondent No. 2 to issue a separate Patta by effecting Sub Division of the property in Survey No. 367/1B, in an extent of undivided 68 cents out of 1 Acre 36 Cents, situated at Karivalamvantha Nallur Village, Sankarankovil Taluk, Tenkasi District based on the petitioner's application for sub division patta transfer No. 2026/0105/34/013286 dated 04.04.2026 made by the Petitioner within the time stipulated by this Court.

ORDER

The present Writ Petition has been filed for the issuance of a Writ of Mandamus, to direct the respondent No. 2 to issue a separate Patta by effecting Sub Division of the property in Survey No. 367/1B, in an extent of undivided 68 cents out of 1 Acre 36 Cents, situated at Karivalamvantha Nallur Village, Sankarankovil Taluk, Tenkasi District based on the petitioner's application for sub division patta transfer No. 2026/0105/34/013286 dated 04.04.2026 made by the petitioner within the time stipulated by this Court.

2.The 4th respondent submitted that there is a civil dispute pending before the Civil Court.

3.This Court without expressing any opinion on merits is directing the official respondents to consider the petitioner's application, dated 04.04.2026 and pass orders after hearing the submissions of the petitioner and the 4th respondent in accordance to law within a period of three months from the date of receipt of a copy of this order. While considering the said application, the fact that a civil suit is pending shall also be taken into account.

4.With the above observations, this Writ Petition is disposed of. There shall be no

order as to costs.
