to consider the petitioner's representation dated 24.03.2025 and to cancel the fraudulent sale deed No.662/2017 dated 04.01.2017 created by the fourth respondent under the guise of lease deed and the subsequent sale deed No. 623/2025 dated 05.03.2025 executed by the fourth respondent in favour of the fifth respondent and to pass suitable order within the time stipulated by this Court.

ORDER

The Writ Petition is filed for a Mandamus, directing the respondents 1 to 3 to consider the petitioner's representation dated 24.03.2025.

2. Upon hearing the learned counsel for the petitioner and perusing the material records of the case, the case of the petitioner is that the sale deed dated 04.01.2017 created by the fourth respondent is fraudulent. A further document dated 05.03.2025 is also executed on the strength of the said sale deed; the petitioner was made to believe that she was executing a lease deed, and fraudulently, the aforesaid documents came into existence. Therefore, the petitioner has made the present representation. 2/4

It can be seen that for the grievance that is articulated by the petitioner before this Court, the petitioner has to approach the appropriate civil court, and it is not for the respondents 1 to 3 to go into whether the petitioner was lured and taken to the office of the Sub Registrar with a false promise and in the guise of lease deed and they got the sale deed executed or not. This question has to be tried by the appropriate civil Court. Therefore, keeping open the liberty of the petitioner to approach the civil Court, the Writ Petition stands disposed of. No costs.
