Criminal Miscellaneous Petition is filed under section 482 of Criminal Procedure Code, praying this Hon'ble Court to Relax the condition imposed against the Petitioner dated 12.08.2020 made in Crl. A.(MD) No. 227 of 2020.

Criminal Appeal is filed under Section 14A(2) of Scheduled Castes and the Scheduled Tribes (Prevention of Atrocities) Amended Act, 2016, to set aside the order dated 26.06.2020 made in Crl.M.P.No.319 of 2020 on the file of the Special Court for exclusively Trial of Cases under POSCO Act, 2012, Virudhunagar District at Srivilliputtur and enlarge the appellant on bail. ORDER:- Criminal Miscellaneous Petition coming on for hearing on this day and upon perusing the petition and the affidavit filed in support thereof and upon hearing the arguments of Mr.R.Rajamohan, Advocate for the Petitioner and of Mrs. S.Bharathi, Government Advocate On Behalf of the Respondents No.1 and 2, this Court made the following order:

This petition has been filed to relax the condition imposed by this Court in Crl.A.(MD)No.227 of 2020 dated 12.08.2020. 2.On the side of the petitioner, it is stated that this Court https://hcservices.ecourts.gov.in/hcservices/ 1/2

CRL MP(MD). No.5344 of 2020 has granted bail to the petitioner on 12.08.2020, directing the petitioner to appear before the respondent police daily at 10.30 a.m. It is stated that the petitioner is complying the condition till 26.10.2020, after that he met with an accident and could not comply the condition. It is further stated that this petition was filed on 13.10.2020 and the petitioner was complied the condition regularly and prayed the petition to be allowed.

3. Prosecution side has no serious objection.

4. In view of the submissions made by the learned counsel for petitioner, this Court is inclined to relax the condition imposed by this Court in Crl.A.(MD)No.227 of 2020 dated 12.08.2020. Hence, this Criminal Miscellaneous Petition is allowed and the condition imposed on the petitioner is relaxed. The petitioner is directed to appear before the respondent police / A.Mukkulam Police Station as and when required.
