PRAYER : Writ Petition filed under Article 226 of the Constitution of India praying for issuance of a Writ of Mandamus, to direct the fourth respondent to transfer the patta to the name of the petitioner, regarding the natham land, to the extent of 1004 1⁄4 sq.ft (0-01.00 hectare) situated in Old S.No.49/1, New S.No.474/14, Thulaiyanatham Village, Musiri Taluk, Trichy District, as narrated in the petitioner's representation, dated 01.04.2026. ORDER

The present Writ Petition has been filed for the issuance of a Writ of Mandamus, directing the fourth respondent to transfer the patta in the name of the petitioner in respect of the natham land, to the extent of 1004 1⁄4 sq.ft (0-01.00 hectare) situated in Old S.No.49/1, New S.No.474/14, Thulaiyanatham Village, Musiri Taluk, Trichy District, as narrated in the petitioner's representation, dated 01.04.2026.

2.Originally, the property belonged to one Angamuthu, son of Idumban, who claims as ancestral property. During his lifetime, Angamuthu executed a Will dated 30.08.2001 in favour of his son, Palanivel. After the demise of Angamuthu, 2/5

the said Palanivel inherited the property and was in possession and enjoyment of the same. Subsequently, Palanivel sold the property to the petitioner on 21.03.2007 vide Document No. 623 of 2007. Thereafter, the petitioner was in possession and enjoyment of the property. While so, the fifth respondent, taking advantage of the petitioner's absence from the village, attempted to encroach upon the property. Hence, the petitioner filed a suit in O.S. No. 153 of 2007 on the file of the District Munsif Court, Musiri. The suit was decreed in favour of the petitioner on 29.06.2017. Aggrieved by the same, the fifth respondent preferred an appeal in A.S. No. 194 of 2018 before the Principal Sub Court, Tiruchirappalli. The appeal was subsequently transferred to the Sub Court, Musiri, and renumbered as A.S. No. 73 of 2023 and the same was dismissed on 11.10.2023 . The fifth respondent has not preferred any appeal. Hence, the litigation has attained finality. Based on the above circumstances, the petitioner is seeking to transfer patta in his name.

3. According to the petitioner, the patta still stands in the name of the petitioner's vendor's father. Therefore, the fourth respondent is directed to issue notice to the petitioner as well as the fifth respondent and consider the petitioner's representation in the light of above facts and circumstances and pass appropriate orders within a period of three months from the date of receipt of a copy of this order.
