PRAYER: Writ Petition is filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus, directing the respondents to settle petitioner's surrender leave salary of Rs.1,05,500/-for 82 days together with interest at the rate of 6% per annum payable from the date of his retirement to till the date of actual payment.

ORDER

The instant Writ Petition has been filed by a Special Grade Conductor of the transport corporation, seeking a mandamus, to direct the respondents to settle the surrender leave salary of Rs.1,05,500/- for 82 days together with interest.

2. A perusal of the records reveal that the petitioner had attained superannuation on 31.01.2017. However, his surrender leave salary was not paid, due to paucity of fund. The petitioner has sent a representation on 06.04.2023, seeking the above said benefits. So far, there is no response from the authorities, the present writ petition has been filed.

3. Considering the above said facts, the respondents herein are directed to disburse the eligible surrender leave salary of the writ petitioner along with 6% interest from the due date till the date of disbursement within a period of twelve

(12) weeks from the date of receipt of a receipt of a copy of this order. 2/4

4.With the above said observations, this writ petition stands disposed of. No costs.
