O R D E R
This writ petition is filed seeking for issuance of a Writ of Mandamus directing the second respondent to expedite the proceedings in Na.Ka.1889/2013A1 within a stipulated time. 2.Mr.A.Muthukaruppan, Additional Government Pleader takes notice for first and second respondents and Mr.P.Mahendran, learned counsel takes notice for third respondent. By consent, this writ petition is taken up for final disposal at the admission stage itself.
3.The petitioner would state that he purchased a property to an extent of 24,258 square feet in S.No.6087/57 situated at Block
No.91, Pudukkottai Town, through a registered sale deed dated 24.04.1991. The said property was allotted for construction of a school by the Directorate of Town and Country Planning authority. The petitioner also constructed a Primary and Nursery School in the name of A.L.A. Vidayalayam.
4.The petitioner would further state that when he enquired, it was found that the property was mistakenly transferred in the name of the third respondent. Hence, he made a representation to the first respondent on 07.02.2014 to rectify the said mistake. The first respondent, on receipt of the application, referred the matter to the second respondent for appropriate enquiry. Though the enquiry commenced in the year 2014, but so far no finality is reached. Hence, he approached this Court by way of the present writ petition.
5.The learned counsel appearing for the petitioner would submit that it would suffice, if a direction is issued to the second respondent to pass orders on the representation of the petitioner dated 07.02.2014.
6.The learned Additional Government Pleader appearing for the respondent 1 and 2 would submit that the representation of the petitioner will be considered in accordance with law. 7.In the light of the above facts, this Court, without going into the merits of the matter, directs the second respondent to consider the representation of the petitioner dated 07.02.2014 and pass appropriate orders on merits and in accordance with law, after providing opportunity to all necessary parties, within a period of three months from the date of receipt of a copy of this order.
8.With the above direction, this Writ Petition stands disposed of. No costs.
