PRAYER :- For Bail in Crime No. 839 of 2024 on the file of the respondent police. ORDER : The Court made the following order :- The petitioner/sole accused, who was arrested on 13.06.2024 for the alleged 1/4
offence under Sections 273 and 328 of IPC r/w 24(1) of Cigarette and other Tobacco Products Act, 2003 on the file of the respondent police, seeks bail. 2.The case of the prosecution is that on 13.06.2024, the petitioner was found in possession of banned tobacco products worth about Rs.3,679/-. Hence, the complaint.
3.The learned counsel appearing for the petitioner submits that on his advice, the petitioner has realised his mistake and in order to show his bonafide, he has deposited a sum of Rs.25,000/- in favour of the "Chief Educational Officer, Trichy'' for the welfare of the Government School students. 4.Considering this change in the attitude of the petitioner and also considering the period of incarceration, this Court is inclined to grant bail to the petitioner with some conditions.
6. Accordingly, this Criminal Original Petition is ordered and the petitioner is ordered to be released on bail on the following conditions:- i) The petitioner shall execute a bond for a sum of Rs.25,000/-(Rupees Twenty Five Thousand) each with two sureties each for a like sum to the satisfaction of the learned Judicial Magistrate No.I,Trichirappalli. ii) The petitioner and the sureties shall submit a copy of their Aadhaar Card or any other identity card issued by the Government in proof of their residence address; 2/4
iii) The petitioner shall report before the respondent police daily at 10.30 a.m., until further orders. The petitioner has to co-operate for the trial. iv) The petitioner shall file an affidavit of undertaking before the respondent police that he will not indulge in any offence in future. v) The petitioner shall not misuse the liberty granted to him by indulging in any further offence and shall not tamper with the prosecution witnesses. The petitioner shall be available for the trial as well.
