ORDER
[Order of the Court was made by R.SURESH KUMAR, J.] This Habeas Corpus Petition has been filed to direct the respondents to produce the person or body of the petitioner's daughter Gayathiri, D/o.Kannan 20 years old before this Court and hand over her custody to the petitioner.
2.When the case is taken up for hearing, the respondent police have produced the detenue. She stated before us that since she fell in love with the third respondent, she left her parental home and married him on 21.05.2023 and had been residing with him separately. 3.The date of birth of the detenue is 21.12.2003 and that of the third respondent is 24.11.2002. Therefore, the detenue is a major, whereas the third respondent has not completed the age of 21 years for 2/4Page 2 of 4
the purpose of marriage. Therefore, any marriage, if at all as claimed by the detenue and the third respondent on 21.05.2023, that should be a void marriage. Therefore, in this context, it is open to the respondent police to take action in accordance with law.
4. Since the detenue is a major and she is not in the illegal custody of any one including the third respondent, recording the said statement of the detenue, we feel that this petition can be closed. Accordingly, it is closed.
