Prayer : Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Certiorari, calling for the records relating to the impugned order of the respondent dated 05.05.2022 in R.C.No.TNHDC/69/Per/2022 and quash the same as illegal. ORDER

By consent of both the parties, this Writ Petition is taken up for final disposal.

Though the petitioner herein has sought for a larger relief to quash the order of transfer, the learned counsel for the petitioner submitted that the petitioner would be satisfied, if a direction is given to the respondent to consider his representation, dated 07.05.2022, wherein, he has sought for revocation of transfer order and for re-posting him in the same place.

3. In the aforesaid representation, the petitioner had sought for retaining him in the same place from where he was transferred. Since few months have lapsed from the date of the transfer, it will not be appropriate for the respondent to consider such a request. However, if the petitioner is granted liberty to give a fresh representation seeking for transfer in any other place, with a consequential direction to the respondent to consider the same within a stipulated time, the ends of justice could be secured. 2/4

4. In the light of the above observations, there shall be a direction to the petitioner to give a fresh representation to the respondent, seeking for transfer to any other place. On receipt of such a representation, the respondent herein is directed to consider the same, on its own merits and pass appropriate orders in accordance with law, within a period of two (2) weeks from the date of receipt of a fresh representation.

5. With the above direction, the Writ Petition stands disposed of. There shall be no order as to costs. Consequently, connected miscellaneous petition stands closed.
