Respondents Prayer: Writ Petition is filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus, to direct the fourth Respondent to register the sale deed dated 04.12.2025 presented by the petitioner in respect of land comprised in S.Nos.600/1A and 600/1B2 0.17.00 Hectare (42 Cents) and 1.24.00 Hectare (3 Acres 6 Cents) respectively, Radhapuram Village, Radhapuram Taluk, Tirunelveli District, and act in accordance with law. 1/5

ORDER

The writ petition is filed for a mandamus to register the sale deed dated 04.12.2025 presented by the petitioner.

Upon hearing the learned counsel for the petitioner and perusing the material records of the case, the grievance of the petitioner is that the land conveyed comprises survey Nos.600/1A and 600/1B2. While one of the survey numbers is valued on a per cent basis, the other survey number is valued on a per sq.ft., basis. This issued had persisted even in respect of an earlier sale deed pertaining to the same property, which was ultimately referred under Section 47-A, and the value of the property was accordingly determined. However, without carrying on the same in the records, now when the sale deed was presented, it was not even received by the Sub-Registrar.

3. I also heard the learned Special Government Pleader, who taking notice on behalf of the respondents.

4. Even if there is any issue exists, the Sub-Registrar cannot refuse to receive the sale deed or cannot pass any oral orders thereon. The petitioner can present the sale deed within a period of two weeks from the date of receipt of a web copy of the order. Upon which, the same shall be received by the fourth respondent and orders, in accordance with law, shall be passed.

5. Needless to mention that the earlier order passed in respect of the document shall also be duly taken into account and considered in accordance with law. Even if the fourth respondent has any doubt regarding the valuation of the property, it is open to him to register the document and refer it under Section 47-A, if he has reason to believe that the property has been undervalued.

6. With the aforementioned observations and directions, the writ petition stands disposed of.
