PRAYER :- For Bail in Crime No.91 of 2023 on the file of the Respondent Police.

ORDER : The Court made the following order :- The petitioner/A5, who was arrested and remanded to judicial custody on 10.05.2023 for the offence under sections 147, 148, 307, 353, 450 and 506(2) IPC in Crime No.91 of 2023 on the file of the respondent police seeks bail.

2.The case of the prosecution is that the defacto complainant and his friend are accused in a murder case and they were remanded to judicial custody. Due to injuries, they were admitted in the hospital with escort. At that time, the accused persons trespassed into the hospital and attempted to kill the defacto complainant and his friend for retaliation. Hence the case.

3.Heard both sides and perused the materials available on record including the First Information Report. https://www.mhc.tn.gov.in/judis

4.It is seen that there are totally 16 accused persons in this case, in which, the petitioner is arrayed as A5. The brother of the petitioner herein was killed by the defacto complainant in this case, in which, he was also sustained injuries and as such, he was admitted in the hospital with escort. On 18.04.2023, in order to throw away the life of the defacto complainant, the accused persons entered into the Government Hospital, sprayed chilli powder on other persons and started attacking the defacto complainant and his friend brutally. That apart, the petitioner herein is having four previous cases and having very bad antecedents. If the petitioner let out on bail, again he will indulge in very same offence.
