PRAYER : Petition filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus, to direct the first respondent ie, the Secretary to Government, Higher Education (I2) Department, Chennai to pass appropriate orders on the petitioner's representation dated 02.04.2018 based on earlier Government Orders in G.O.(Perm) No.16, Higher Education (I2) Department, dated 10.02.2003 and G.O(Perm) No.14, Higher Education (I2) Department dated 27.01.2004 in similar and identical cases, within a specified time frame that may be fixed by this Court. This writ petition has been filed seeking a Writ of Mandamus to direct the first respondent ie, the Secretary to Government, Higher Education (I2) Department, Chennai to pass appropriate orders on the petitioner's representation dated 02.04.2018 based on earlier Government Orders in G.O.(Perm) No.16, Higher Education (I2) Department, dated

10.02.2003 and G.O(Perm) No.14, Higher Education (I2) Department dated 27.01.2004 in similar and identical cases.

2. Heard Mr.S.Visvalingam, learned counsel appearing for the petitioner and Mr.M.Satheesh Kumar, learned Additional Government Pleader appearing for the respondents.

3. The respondent has filed a counter affidavit stating that an identical claim made by the petitioner and other similarly situated persons had already been considered and rejected by the Government as early as on 08.11.2018 vide Government Letter No.12650, Higher Education (I2) Department/2014-10. It is further submitted by Mr.M.Satheesh Kumar, learned Additional Government Pleader appearing for the respondent, that unless and until the petitioner challenges the said proceedings dated 08.11.2018 in the manner known to law, the relief sought for in the present writ petition cannot be granted.

4. In view of the above submission, Mr.S.Visvalingam, learned counsel for the petitioner seeks liberty from this Court to challenge the proceedings dated 08.11.2018.

5. In the light of the above, this Court is of the view that the relief sought for in the present writ petition cannot be granted. Accordingly, this writ petition is dismissed, granting liberty to the petitioner to take appropriate steps to the proceedings dated 08.11.2018 in accordance with law. There shall be no order as to costs.
