ORDER

The petitioner / wife seeks transfer of proceedings in IDOP.No. 54 of 2020 filed by the respondent / husband, on the file of the Principal District Judge, Srivilliputur, seeking Divorce, to the Family Court, Madurai. The transfer is sought for solely on the ground that the petitioner / wife is a resident of Madurai.

2. The learned counsel appearing for the respondent would submit that the respondent / husband is working at Chennai. He will have to appear before the Family Court in person for every hearing. According to the learned counsel, the said requirement of personal appearance for every hearing would cause considerable hardship and inconvenience to the respondent / husband.

3. Considering the claim made, I am of the opinion that IDOP could be transferred to the Principal District Court at Madurai, so that the husband could appear through his counsel and as such, he can avoid personal appearance for every hearing.

4. In view of the above, IDOP.No.54 of 2020 pending on the file of the Principal District Court, Srivilliputur is withdrawn and transferred to the file of the Principal District Court, Madurai, to be heard and dispose of in accordance with law. The Principal District Court, Srivilliputur is directed to transmit the papers to the Principal District Court, Madurai forthwith. https://hcservices.ecourts.gov.in/hcservices/ 1/2

5. Accordingly, the Transfer Civil Miscellaneous Petition is disposed of. No costs. Consequently, the connected Miscellaneous Petition is closed.
