O R D E R
This petition has been filed to direct the respondents 2 and 3 not to harass the petitioner and his family members in connection with Crime No.157 of 2021 on the file of the third respondent police under the guise of enquiry.
2.The learned counsel for the petitioner would submit that on the basis of the complaint given by the petitioner's brother-in-law namely Sasi Kumar, the third respondent police registered the case in Crime No.157 of 2021 for the offences under Sections 8(c), 20(b) (ii)(c) of NDPS Act. He would further submit that the respondents 2 and 3 are harassing and threatening the petitioner not to attend his sister's marriage which is to be held on 20.08.2021. He would further submit that the third respondent has filed the anticipatory bail petition before this Court and the same was dismissed. https://hcservices.ecourts.gov.in/hcservices/ 1/2
Crl.O.P.(MD)No.11675 of 2021 3.The learned Additional Public Prosecutor would submit that except for the investigation purpose, the petitioner was not called by the investigating officer, for any other purpose. 4.Considering the facts and circumstances of this case, this Court feels on the basis of submission of learned Additional Public Prosecutor that the respondents 2 and 3 have not made any harassment under the guise of enquiry against the petitioner. Hence, this Court directs the petitioner to cooperate with the enquiry. Further, a liberty is granted to the petitioner, if any harassment is made to attend his sister's marriage, to make a complaint to the first respondent herein.
5. With the above directions, this Criminal Original Petition is disposed of .
