RESPONDENT/ RESPONDENT Petition praying that in the circumstances stated therein and in the affidavit filed therewith the High Court will be pleased to condone the delay of 663 days in preferring Civil Revision Petition as against the order dated 25.01.2017 passed in IA.No.271/2016 in HMOP.No.6/2015 on the file of 1st Additional Sub Court, Madurai (Melur Camp) and pass suitable orders and thus render justice. ORDER : This petition coming on for orders upon perusing the petition and the affidavit filed in support thereof and upon hearing the arguments of M/S.S.MANIKANDAN, Advocate for the petitioner, the court made the following order:- This petition is filed to condone the delay of 663 days in filing the above revision petition.
2.The learned Counsel for the petitioner is unable to connect himself and has not participated. The learned Counsel for the respondent is also could not connect himself. 3.This Court has carefully considered the reasons stated in the affidavit filed in support of this petition. The petitioner has stated that he is working as Part Time Security in a Toll Gate at Viralimalai and that he could not get the communication sent by his Counsel to him about the status of copy application. Though the reasons stated by the petitioner are convincing, the delay could have been avoided, if due diligence is shown by the petitioner. Hence, this Court is inclined to allow this petition on terms. 4.Accordingly,this petition is allowed and the delay is condoned on condition that the petitioner pay a sum of Rs.2,500/- to the credit of "Sidha Clinic" attached to this Bench within a period of two weeks from the date of receipt of a copy of this order, https://hcservices.ecourts.gov.in/hcservices/ 1/2
CMP(MD) No.7785 of 2019 failing which, this petition shall automatically be dismissed without further reference to Court.
