Heard Mr.Chinraj, learned Counsel for the petitioner and Mr.M.Prakash, learned Additional Government Pleader for the respondents 1 to 3.
2.The relief sought in the Writ Petition is for a Mandamus seeking a direction to the first, second and third respondents not to register any document based on a string of documents, as given in the Writ Petition. 2/5
3.It is also stated that this restraint should be in effect till disposal of O.S.No.126 of 2022 now pending before the District Munsif-cumJudicial Magistrate, Ottapidaram in Tuticorin District. 4.The relief cannot be granted. The Writ Petition has to be necessarily dismissed. The petitioner always has a liberty to file necessary application before the said suit seeking an order of injunction against the defendants therein. But, Article 226 of Constitution cannot be invoked to seek an order of injunction.
5.Giving that particular liberty to the petitioner herein, the Writ Petition stands dismissed. No costs. Consequently, connected miscellaneous petition is closed.
