ORDER

Heard the learned counsel appearing for the petitioner and the learned Additional Government Pleader appearing for R1.

2. The petitioner wants this Court to direct the first respondent to take departmental action against the second respondent. Since the first respondent did not act on the petitioner's representation dated 23.03.2023, the present writ petition came to be filed.

3. I am not persuaded by the submission of the learned counsel appearing for the petitioner. As rightly pointed out by the learned Additional Government Pleader, if according to the petitioner, the second respondent has filed a misleading affidavit in W.P.(MD)No.15369 of 2022, this aspect of the matter can very well be highlighted, when the said writ petition is taken up for final hearing. Admittedly, the said writ petition is still pending. When this Court is seized of the matter, it would not be proper for this Court to give a direction to the first respondent to take action. The petitioner can revive his request after disposal of W.P. (MD)No.15369 of 2022. Cause of action is yet to fructify. 2/4
