ORDER : The Court made the following order :- The petitioner / Accused No.6, who was arrested and remanded to judicial custody on 23.07.2024. The petitioner, who is facing trial in S.C.No.13 of 2022 on the file of the learned Principal District Judge, Sivagangai, for the offences punishable under Sections 302, 120(b), 147, 148, 109, 342 and 149 of IPC in connection with Crime No.310 of 2019 on the file of the respondent police, seeks bail.

2. The allegation against the petitioner is that the petitioner was earlier arrested and released on bail before the Sessions Court. Subsequently, the petitioner failed to appear before the trial Court on 15.03.2022 and non bailable warrant was issued against him on 15.03.2022. Thereafter, the same was executed on 23.07.2024.

3. The learned counsel appearing for the petitioner submits that if bail is granted to the petitioner, he may not abscond and he is ready to co-operate with the trial. He further submits that the petitioner has been arrested and he is languishing in jail from 23.07.2024. Therefore, he prays for grant of bail.

The learned Additional Public Prosecutor appearing for the respondentPolice submits that since the petitioner was unable to appear before the trial Court on 15.03.2022, non bailable warrant was issued against him on 15.03.2022 by the trial Court. Thereafter, the same was executed on 23.07.2024 and the petitioner was arrested only after two years. He further submits that the case is now pending for 2/3

trial. Accordingly, he prays to dismiss this petition.

5. Considering the fact that the petitioner was absconded for more than two years and, taking note of the fact that if bail is granted to the petitioner he may abscond and thereby, cause delay in the trial proceedings, this Court is not inclined to grant bail to the petitioner.
