For Respondent : Mr.M.Vaikkam Karunanithi, Government Advocate (Crl.Side) PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- For Anticipatory Bail in Crime No.29 of 2022 on the file of the Respondent Police.

ORDER : The Court made the following order :- The petitioner/Accused No.3, apprehending arrest at the hands of the respondent police for the alleged offences punishable under Sections 498(A), 406 and 506(i) I.P.C, in Crime No.29 of 2022 on the file of the respondent police, seeks anticipatory bail.

2. The petitioner along with co-accused filed Crl.OP(MD) No.11603 of 2022 and that was allowed in respect of the first petitioner is concerned. Insofar as the this petitioner is concerned, that was dismissed on the ground that serious allegation has been made against the petitioner, he happened to be the maternal uncle of the defacto complainant.

3. The learned counsel for the petitioner submitted that even though after a lapse of month, no arrest has been made and the second accused was enlarged on bail and the first accused was arrested and remanded to judicial custody, later, released on bail. On that ground, he filed this second anticipatory bail.

4. It appears that the allegation that has been made against the petitioner still stands today. When serious allegation i.e., misbehaviour attributed against the petitioner, it requires thorough investigation.
