ORDER : The Court made the following order :- The petitioner/Accused No.2, who was arrested and remanded to judicial custody on 28.03.2025, based on NBW issued on 03.07.2023 in C.C.No.1120 of 2022 for the offences punishable under Section 392 IPC in Crime No.162 of 2022 on the file of the respondent police, seeks bail.
2.The case of the prosecution is that the petitioner and other accused snatched a gold chian from the defacto complainant, worth about Rs.1,50,000/-. Hence, the complaint. Originally, the petitioner was arrested and bail was also granted. 1/3
Thereafter, the petitioner failed to appear before the trial Court and hence, nonbailable warrant was issued on 03.07.2023 and the same was executed on 28.03.2025. 3.The learned counsel for the petitioner submitted that the petitioner is the bread-winner of the family and he has been regularly appeared before the trial Court and due to illness, he was unable to appear. Further, he submitted that the petitioner will abide by any condition and prays to grant bail to the petitioner. 4.The learned Additional Public Prosecutor appearing for the respondent submitted that the petitioner is a habitual offender and he is having 12 previous cases, which are all similar in nature. Further, he submitted that the petitioner also absented nearly for two years. Hence, he opposes to grant bail to the petitioner. 5.Considering the antecedents of the petitioner and also considering the fact that he was absented before the trial Court nearly for two years, this Court is not inclined to grant bail to the petitioner. Accordingly, this criminal original petition is dismissed.
