Respondents PRAYER: Writ Petition is filed under Article 226 of the Constitution of India praying for the issuance of a Writ of Mandamus directing the respondents herein to take immediate and appropriate steps to establish a Primary Health Centre in Alavayal Village, Pudukottai District after taking into the consideration of the Primary Health Centre which was functioning at Ponnamaravathi Town has been upgraded as Taluk Hospital and also in pursuance of representation dated 18.10.2016 and also the Reply proceedings of the third respondent dated 09.11.2016 made in Na.Ka.No.3214/A3/2015. ORDER
[Order of the Court was made by A.SELVAM, J.] This writ petition has been filed under Article 226 of the Constitution of India praying to direct the respondents to establish a Primary Health Centre in Alavayal Village, Ponnamaravathi Taluk, Pudukkottai District, by way of issuing a writ of mandamus.
2.It is averred in the petition that the petitioner is a resident of Alavayal Village, Ponnamaravathi Taluk, Pudukkottai District, wherein no Primary Health Centre is available. Under the said circumstances, a representation has been given on 18.10.2016, but the same has not yet been considered by the third respondent and therefore the present writ petition has been filed for getting the relief sought therein.
3.The learned Special Government Pleader appearing for the respondents has contended to the effect that as per order passed in W.P(MD)No.7245 of 2015, a proposal has been sent to the Government so as to establish a Primary Health Centre in Alavayal Village.
4.Considering the representation made on the side of the respondents, this Court is inclined to pass the following order.
5.In fine, this writ petition is allowed without costs and the fourth respondent is directed to look into the proposal and if there is any possibility to establish a Primary Health Centre in Alavayal Village, Ponnamaravathi Taluk, Pudukkottai District, establish the same as early as possible.
