ORDER : The Court made the following order :- The petitioner/Accused No.1, who was arrested and remanded to judicial custody on 24.04.2025 for the offences punishable under Sections 275 and 123 of BNS, 2023 and Section 24(1) of Cigarette and Other Tobacco Products Act, 1/3

2003 in Crime No.194 of 2025 on the file of the respondent police, seeks bail. 2.The case of the prosecution is that on 24.04.2025, at about 06.15 hours, based on secret information, the respondent-Police apprehended the accused persons and on enquiry found that they are selling tobacco products. The respondent-Police seized 556 kg of tobacco products from the accused persons in 22 bags. Hence, the case.

3. The learned counsel for the petitioner submits that the petitioner is an innocent person and he has not committed any offence as alleged by the prosecution. However, he has been arrested and he is languishing in jail from 24.04.2025. Therefore, he prays for grant of bail.

4. The learned Additional Public Prosecutor appearing for the respondent opposed for grant of bail on the ground that 556 kg of banned tobacco products was seized from the petitioner and other accused persons. He further submits that the petitioner has six previous cases.

5. Considering the huge quantity of contraband (556 kg of banned tobacco products) involved in the present case and considering the antecedents of the 2/3

petitioner, this Court is not inclined to grant bail to the petitioner. Accordingly, this Criminal Original Petition is dismissed.
