O R D E R

This writ petitioner is filed for issuance of writ of mandamus directing the second respondent to take appropriate action against the respondents 3 and 4 on the basis of the complaint given by the petitioner on 20.10.2020.

2. When the matter was taken up for hearing on 04.10.2021, there was no representation for the petitioner and therefore, the matter was directed to be listed under the caption 'for dismissal.' However, on that day the learned Additional Public Prosecutor submitted that based upon the complaint given by the petitioner enquiry was undertaken in CSR No.369 of 2021 and the same is pending.

3. Today when the matter is taken up hearing, the learned Additional Public Prosecutor would submit that the parties have entered into compromise for which the first installment was also paid.

4. It appears that compromise was entered into between the parties on 20.10.2021 and part of the amount has also been received and after that this petition came to be filed stating that the complaint must be properly enquired.

5. Even though the matter has been listed today under the caption 'for dismissal', there is no representation for the petitioner. However, in view of the submission of the learned Additional Public Prosecutor, this petition is dismissed as infructuous.
