ORDER : This Court made the following order :- The petitioner / Accused No.6, who apprehend arrest at the hands of the respondent police for the offences punishable under Sections 104, 115(2), 126(2), 191 (2), 296(b) and 194 of BNS in Crime No.86 of 2025, on the file of the respondent police, seek anticipatory bail.
2. The case of the prosecution is that on 17.04.2025, the defacto-complainant and her husband were travelled on their two wheeler, at that time, this petitioner and other accused had intercepted the two wheeler and abused them in filthy languages and attacked the Defacto-complainant's husband namely Arunpandian for which he suffered from fits and he sustained severe injury. He died on 20.04.2025. Hence the complaint.
3. The learned counsel appearing for the petitioner would submit that the petitioner is innocent and a false case has been foisted against him. Further, he would submit that the petitioner is ready to abide by any condition imposed by this Court. Hence, he seeks anticipatory bail.
4. The learned Government Advocate (Crl side) would submit that the petitioner and other accused were brutally attacked the Defacto-complainant's husband and thereby he sustained severe injury and he suffered from fits. Later, he 2/4
died on 20.04.2025. In this case, investigation is still pending and some of the accused persons are still in judicial custody. The allegations against the petitioner are serious in nature. Hence he would strongly oppose to grant anticipatory bail to the petitioner.

Taking into consideration of the facts and circumstances of the case and also the fact that the allegations are serious in nature, the other accused persons are still in custody and also considering the gravity and nature of offences, this Court is not inclined to grant anticipatory bail to the petitioner.
