ORDER
The petitioner is an accused in Crime No.193 of 2024 on the file of the respondent police. The said case was registered for the offence under Sections 294(b) and 341 IPC and Sections 3(1)(s), 3(1)(r) and 3(2)(va) of Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989.
2.Section 18 of the SC/ST (POA) Act prohibits grant of anticipatory bail in the cases registered under the SC/ST (POA) Act. The petitioner claims that this case is a foisted one and he will prove his innocence. In view of the bar under Section 18 of the SC/ST (POA) Act, the petitioner is inclined to surrender before the Special Court concerned and to seek regular bail. However, the petitioner seeks a direction for disposal of the bail application on the same day. 2/5
3.The learned Government Advocate(Crl.side) appearing for the official respondents opposes to allow this petition on the ground that the petitioner is having following previous cases:- 1.Cr.No.55 of 2017 u/s 294(b), 307 IPC and Section 3(1) TNPPDL Act, 2.Cr.No.378/22 u/s 294(b), 324, 355, 506(ii) IPC, 3.Cr.No.71/23 u/s 294(b), 353, 507, 506(i) IPC and 4.Cr.No.363/23 u/s 294(b), 353, 506(2) IPC and Section 25(1A) of the Arms Act.
4.Considering the antecedents of the petitioner, this Court is not inclined to entertain this petition. Accordingly, this criminal original petition is dismissed.
