Respondents Prayer: Writ Petition filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus, directing the respondents 1 to 3 to consider the representation / rquest of the petitioner dated 19.06.2021 and to initiate appropriate action in accordanc with law within the time frame to be fixed by this Court to remove the electricity meter box of the fifth respondent which is mounted on the petitioner's western wall and to palce it in some other safer place within the fifth respondent's property. ORDER
Heard the learned counsel on either side.
2. The electricity meter box in respect of the fifth respondent service connection has been installed on the petitioner's wall. https://www.mhc.tn.gov.in/judis 1/2
W.P.(MD)No.14726 of 2021 Seeking to shift it, he gave a petition dated 19.06.2021. Since it was not acted upon, the present Writ Petition came to be filed. The fifth respondent has not entered appearance to contest the case of the petitioner.
3. When the matter was taken up for hearing, I called upon the learned Standing Counsel to get instructions in this regard. Today, when the matter was taken up for hearing, the learned Standing Counsel submitted that the electricity meter box is not on the wall of the fifth respondent's house. Obviously it cannot continue to be on the petitioner's wall forever. Therefore, I direct the fourth respondent to remove the electricity meter box pertaining to the fifth respondent service connection forthwith and without any delay. It is for the fifth respondent to indicate the appropriate place where it can be installed.
4. This Writ Petition is allowed accordingly. There shall be no order as to costs.
