PRAYER :- For Bail in Crime No.350 of 2024 on the file of the Respondent Police. ORDER : The Court made the following order :- The petitioner/Accused 6, who was arrested on 03.05.2024, for the offence under Sections 147, 302 of IPC @ 120(B), 147, 148 and 302 of IPC in Crime No.350 of 2024, on the file of the respondent police, seeks bail. 1/3
2.The case of the prosecution is that one Kayalvizhi, wife of Sekar lodged a complaint before the respondent police against the petitioner and five others that previously, her husband's brother's son, Silambarasan was murdered in 2021, implicating her family members in the case. This incident led to ongoing animosity between the two families. The petitioner and other accused assaulted the said Kayalvizhi's son with deadly weapons and he died. Hence, the case. 3.The learned counsel appearing for the petitioner submits that the petitioner is an innocent and he has not committed any offence as alleged by the prosecution. There is a dispute between the first accused family and the defacto complainant's family. In order to wreak vengeance, the present complaint has been lodged. Without conducting proper investigation, the petitioner has been implicated in this case.
4.The learned Additional Public Prosecutor appearing for the respondent submits that this is a retaliation murder. Totally, there are seven accused in this case. The petitioner is A7. The specific overt act as against this petitioner is that he has surrounded the deceased, when the other accused attacked him. 5.Considering the nature of offence, this Court is not inclined to grant bail to this petitioner.
