Respondents PRAYER: Petition filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus directing the 1st and 2nd Respondents to upgrade the Vallal Pari Municipal Middle School situated in Ramanathapuram Taluk, Ramanathapuram District by considering the 5th respondent proceedings in Na.Ka.No. 1689/A5/2022 dated 04.05.2023 based on the petitioner representation dated 08/04/2022.

[Order of the Court was made by R.SUBRAMANIAN, J.] Mr.D.Sadiq Raja, learned Additional Government Pleader, takes notice for the respondents.
2. With the consent of both sides, the writ petition is taken up for final hearing at the admission stage itself.
3. Prayer in this writ petition reads as follows: "For the reasons stated in the accompanying affidavit it is therefore prayed that this Hon'ble Court may be pleased to issue a writ or order or direction more in the nature of WRIT OF MANDAMUS directing the 1st and 2nd Respondents to upgrade the Vallal Pari Municipal Middle School situated in Ramanathapuram Taluk, Ramanathapuram District by considering the 5th respondent proceedings in Na.Ka.No. 1689/A5/2022 dated 04.05.2023 based on the petitioner representation dated 08/04/2022."
4. The learned Additional Government Pleader appearing for the respondents would submit that the question of upgrading of the school is under active consideration of the Commissioner of the School Education and it is to be forwarded to the Government and a final decision is to be taken only by the Government. He has also produced the proceedings of the Chief Educational Officer, Ramanathapuram District, dated 27.07.2021, recommending for upgradation of the school to the Director of School Education.
5. Hence, the writ petition is dismissed for the present leaving it open to the petitioner to renew it if the school is not upgraded by the next academic year. No costs.
