ORDER : The Court made the following order : The petitioner, who was arrested and remanded to judicial custody on 18.07.2021, in connection with the case registered in Crime No.1195 of 2021 for the offence punishable under Sections 8(c) r/w 20(b)(ii)(B) of NDPS Act, has filed this application seeking bail.

2. The prosecution case is that on a secret information regarding sale of Ganja, the defacto complainant conducted a raid and found that the petitioner was in possession of 1.100 kgs of Ganja. Hence, the complaint.

3. Learned Counsel for the petitioner submitted that the petitioner is an innocent and has not committed any offence as alleged by the prosecution. However, a false case has been foisted as against him and therefore, prays for grant of bail.

4. Learned Additional Public Prosecutor, on instructions, submitted that apart from this case, the petitioner is having five previous cases to his credit, of which, three cases are for NDPS offence.

5. Considering the nature of allegation and the antecedents of the petitioner, this Court is not inclined to grant bail to the petitioner.
