JUDGMENT

(Judgment of the Court was made by S.SRIMATHY, J.) This writ appeal is filed against the order dated 12.04.2024 made in W.P(MD)No.21993 of 2023.

Even though the complaint against the teacher namely, Tmt.Mary Stella is serious, after verifying the records circulated by the police officials, it is seen that there is a prima facie case made against her husband under the provisions of the Tamil Nadu Prevention of Dangerous Activities of Bootleggers, Cyber law offenders, Drug offenders, Forest-offenders, Goondas, Immoral Traffic Offenders, Sand offenders, Sexual-offenders, Slum-grabbers and Video Pirates Act 1982, and he was arrested and still in Prison. The school in which his wife is working, is before this Court. She is placed under suspension for more than three years. The allegation against her is that she has not taken action when the complaint was made by the students. Page No.2 of 4

Therefore, we are inclined to interfere with the impugned order. The order of suspension is revoked. However, the teacher namely, Tmt.Mary Stella shall not seek regularisation of suspension now itself. Those issues will be considered after the completion of the criminal case. The teacher shall be allowed to work in the appellant school.

With the above direction, the impugned order is modified and the Writ Appeal is disposed of. No costs. Connected miscellaneous petitions are closed.
