Writ Petition is filed under Article 226 of the Constitution of India, praying this Court To issue a WRIT OF CERTIORARIFIED MANDAMUS calling for the records pertaining to the impugned order issued by the 3rd respondent in his proceedings in Na.Ka.No.12633/2015/B3 dated 26.10.2015 and quash the same and consequently direct the 3rd respondent to restore the patta, taluk and village A register, Village Adangal, Computer Chitta and relevant revenue records in the name of the petitioner and his wife and the lands classification to be changed against as ryotwariprivate patta lands in respect of the properties comprised in Survey 1/3
Nos.124/1, 124/2, 127/3, 129/2, 129/3 situated at Ambalakaranpatti Village standing in the name of the first petitioner and also the lands in survey No.124/3 situated at Ambalakaranpatti Village in the name of the second petitioner of Melur Taluk, Madurai District. ORDER
(Order of the Court was made by M.M.SUNDRESH, J.) In compliance of the order passed by the Court, including the Division Bench, the contemnor has passed an order.
2. If the petitioners are of the view that the said order is not correct legally and not in compliance of the order passed by the Court, the remedy lies elsewhere. Suffice it to state that we do not find any wilful disobedience on the part of the respondents.
3. At this point of time, the first petitioner / party-inperson submitted that an appeal has been preferred before the District Revenue Officer, Madurai, on 18.06.2020. However, the same has not been disposed of, notwithstanding the communication dated 15.07.2020 sent by the District Revenue Officer, Madurai, to the Revenue Divisional Officer, Melur.
4. In such view of the matter, we direct the District Revenue Officer, Madurai Collectorate, Madurai, to dispose of the pending appeal filed by the petitioners dated 18.06.2020, within a period of three months from the date of receipt of a copy of this order, without being influenced by the order passed in this petition.
