O R D E R

This writ petition has been filed for a Mandamus seeking for a direction to the first respondent i.e., the District Collector, Sivagangai to send pension proposals of the petitioner as per the application for service pension given in the format prescribed on 21.03.2022 within a specified time frame that may be fixed by this Court.

It is submitted by the learned counsel for the petitioner that the petitioner was appointed as Village Assistant on 01.06.1995 and then he was promoted to the pose of Office Assistant in the Taluk Office, Karaikudi, on 28.05.2018. He was allowed to retire on attaining the age of superannuation on 30.11.2021, as per the proceedings No.K.Dis.A3/30239/2021 of the Personal Assistant (General) to the District Collector, Sivagangai. Till now, his pension proposal has not been sent to the Accountant General, Chennai and therefore, he is 2/6

struggling to lead to his normal life. Therefore, this writ petition has been filed.

3. Mrs.D.Farjan Ghousia, learned Special Government Pleader takes notice on behalf of the respondents.

4. A perusal of letter of the Tahsildar, Karaikudi, in ref. No.Na.Ka.Aa1/2004/2021, dated 12.11.2021, of the Tahsildar, Karaikudi, shows that there is no adverse remarks / charges pending against the petitioner; there is no amount due from the petitioner and therefore, the Tahsildar, Karaikudi, recommended that the petitioner is permitted to retire from service on attaining the age of superannuation. On the basis of his recommendation, the Personal Assistant to District Collector, Sivagangai, had passed an order in proceedings No.K.Dis.A3/30239/2021 dated 30.11.2021, permitting the petitioner to retire from his service on 30.11.2021. It has been more than 7 months, since the petitioner retired from service and it is unfortunate that his pension proposal has not yet been forwarded to the Accountant General, Chennai.

In view of the above, this Court directs the first respondent-District Collector, Sivagangai to send the pension proposal of the petitioner to the Accountant General, Chennai, in the prescribed format as submitted by the petitioner on 21.03.2022, within a period of four weeks from the date of receipt of a copy of this order.

6. With the above direction, this writ petition is disposed of. No costs.
