O R D E R
The petitioners/accused 1 and 2, who apprehend arrest at the hands of the respondent police for the offences punishable under sections 191(2), 296(b), 132, 351 (2), 333 of BNS, 2023 in Crime No.107 of 2025 on the file of the respondent police, 1/5
seeks anticipatory bail.
2. The case of the prosecution is that on 09.05.2025 at 7.00 pm., the petitioners and some unidentified persons used abusive language against the temple officials and staff and physically attacked the staff members of the temple for not giving respect during the chariot procession. It is alleged that the accused threatened them by saying that they would file a complaint under PCR (Protection of Civil Rights) Act against the officials. Hence, the case has been registered.

The learned counsel appearing for the petitioner submits that the petitioner is an innocent person and he has not committed any offence as alleged by the prosecution and his name has been falsely implicated in this case. The petitioners were not at the scene of occurrence as alleged in the FIR. He would further submit that the petitioner will never abscond and will not tamper the witnesses and also ready to abide by any condition imposed by this Court and hence, he seeks to grant bail to the petitioner.
4. The learned Government Advocate (Crl side) would submit that the petitioners have no bad antecedents and they have not even involved in any of the offences.
5. Taking into consideration of the facts and circumstances of the case and also the fact that the petitioners have no bad antecedents and also they have not involved 2/5
in any offence, this court is inclined to grant anticipatory bail to the petitioners, with certain conditions:

Accordingly, the petitioners are ordered to be released on bail in the event of arrest or on their appearance, within a period of fifteen days from the date on which the order copy made ready, before the learned Judicial Magistrate, Theni District, on condition that the petitioners shall execute a bond for a sum of Rs.
10,000/- (Rupees Ten Thousand only) each with two sureties each for a like sum to the satisfaction of the respondent police or the police officer who intends to arrest or to the satisfaction of the learned Magistrate concerned, failing which, the petition for anticipatory bail shall stand dismissed and on further condition that: (a)the petitioners and the sureties shall affix their photographs and left thumb impression in the surety bond and the Magistrate may obtain a copy of their Aadhar card or Bank pass Book to ensure their identity; (b)the petitioners shall report before the respondent police daily at 10.30 a.
(d)the petitioners shall not abscond either during investigation or trial; (e)on breach of any of the aforesaid conditions, the learned Magistrate/ Trial 3/5
Court is entitled to take appropriate action against the petitioners in accordance with law as if the conditions have been imposed and the petitioners released on bail by the learned Magistrate/Trial Court himself as laid down by the Hon'ble Supreme Court in P.K.Shaji Vs. State of Kerala [(2005) AIR SCW 5560]; and; (f)if the accused/petitioners thereafter abscond, a fresh FIR can be registered under Section 269 BNS.
