ORDER : The Court made the following order :- The petitioner, who apprehends arrest at the hands of the respondent police for the offences punishable under Section 4(1)(A) & 4(1)(C) of the Tamil Nadu Prohibition (Amendment) Act, 2024, in Crime No.39 of 2025, on the file of the respondent police, seeks anticipatory bail.
2.The case of the prosecution is that on 11.05.2025, the de-facto complainant along with his subordinates were on usual patrol near Veerapathiran shop at Pothikulam. There he found the motor bike bearing registration No. TN 65 K 2295 standing in a suspicious manner. On searching, the de-facto complainant found 80 IMFL bottles of liquor (each 180 ml) without any permission or license to sell. Hence, this case.
3.The learned counsel appearing for the petitioner submitted that he has been falsely implicated in this case and he has not committed any offence. He seeks this Court to grant anticipatory bail to the petitioner. 4.The learned Government Advocate (Crl.) appearing for the respondent police 2/3
submitted that co-accused still in custody and the petitioner is having 13 previous cases, out of which, 9 cases have already been disposed of, and 4 cases are still pending.
5.Considering the facts that the co-accused is still in custody and the bad antecedents of the petitioner, this Court is not inclined to allow this petition.
