O R D E R
[Order of the Court was made by N.ANAND VENKATESH, J.] This Writ Petition has been filed challenging the impugned proceedings of the first respondent made in No.241805/ThaKu.4/2026 dated 26.03.2026 and for a consequential direction to the first respondent to grant three days emergency leave without police escort to the petitioner's son, who is undergoing sentence at Central Prison, Tiruchirappalli.
2. Heard the learned counsel for the petitioner and the learned Additional Public Prosecutor appearing on behalf of the respondents.
3. The petitioner is the mother of the convict. The convict is undergoing a life sentence at Central Prison, Tiruchirappalli. The petitioner
made a representation seeking for grant of emergency leave on the ground that the mother of the convict is facing serious health issues. The representation made by the petitioner came to be rejected by the first respondent through the impugned proceedings dated 26.03.2026, stating that the report of the Probation Officer clearly demonstrated that the mother of the convict is hale and healthy and therefore, the reason for which, the emergency leave was sought for is not true. Aggrieved by the same, the present Writ Petition has been filed before this Court.
4. When the matter came up for hearing yesterday, the learned Additional Public Prosecutor sought some time to file a report of the Jail Superintendent, Central Prison, Tiruchirappalli. Accordingly, the matter was listed for hearing today and the report of the Jail Superintendent was placed before this Court.
5. The learned Additional Public Prosecutor submitted that there is an apprehension that this convict will abscond if he is let out on emergency leave.
6. Taking into consideration the objections raised on the side of the respondents and considering the reason for which, the emergency leave has been sought and also taking note of the fact that the convict has undergone sentence for more than five years and he was granted ordinary leave and emergency leave on earlier occasions, we are inclined to interfere with the impugned proceedings of the first respondent dated 26.03.2026 and the same is hereby set aside. There shall be a direction to the first respondent to grant three days emergency leave to the convict, subject to the condition that one escort will accompany the convict during the entire emergency leave period.
7. This Writ Petition is disposed of in the above terms.
