To call for the records of the concurrent Judgement of conviction and sentence passed by the Learned III Additional District and Sessions Judge, Trichy in Crl.A.No.174 of 2019 dt.10/6/2022, confirming the judgement of conviction and sentence passed by the II Additional Assistance Sessions Judge, Tiruchirappalli in S.C.No.2 of 2018 dated 12.12.2019, is concerned. Order : This petition coming up for orders on this day, upon perusing the petition filed in support thereof and upon hearing the arguments of M/S.MAREESKUMAR E, Advocate for the petitioner and of MR.M.SENTHIL KUMAR, Government Advocate (Crl.Side) on behalf of the Respondent, the court made the following order:- This Criminal Miscellaneous Petition is filed to suspend the conviction and sentence imposed against the petitioner in Crl.A.No.174 of 2019, dated 10.06.2022 by the learned III Additional District and Sessions Judge, Trichy and enlarge the bail pending disposal of the Criminal Revision Case.
2.Challenging the conviction and sentence, the petitioner has preferred the present Criminal Revision Case along with the instant Miscellaneous Petition seeking suspension of sentence. https://www.mhc.tn.gov.in/judis 1/2
CRL MP(MD) No.7825 of 2022 3.The learned Counsel for the Revision Petitioner would submit that he has to take care of his ailing mother. So that the suspension of sentence may be considered by this Court. Further, he would submit that six years of imprisonment was awarded and he was directed to surrender before the concerned authority. Now, he also surrendered before the concerned authority as per the condition imposed in Crl.R.C.(MD) No.620 of 2022.
4.The learned Government Advocate (Crl.Side) would submit that he will argue the main matter after receiving the records from the concerned Court.
5.In view of the above submissions made by the revision petitioner, the interim suspension of sentence is ordered. 6.Accordingly, I am inclined to enlarge the petitioner on bail, by suspending the substantive part of sentence of imprisonment temporarily, with the following conditions:- The petitioner is directed to be enlarged on bail on condition that the petitioner shall execute a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the III Additional District and Sessions Judge, Trichy. 7.Call on 16.12.2022 for reporting compliance. sd/- 06/12/2022 / TRUE COPY / 08/12/2022 Sub-Assistant Registrar (C.S.)
