ORDER
This Criminal Revision Case is filed to set aside the order passed in Crl.M.P. No. 894 of 2025 in S.T.C.No. 22 of 2022 dated 09.04.2026 on the file of the learned Judicial Magistrate No.1, Pudukottai and direct the Learned Judicial Magistrate No.1, Pudukottai to issue summons to the Deputy Registrar of Companies, Chennai, to produce the documents as listed in Cr.M.P.No.894 of 2025.

The learned counsel for the petitioner submitted that he had filed an application under section 243 of Cr.P.C., of BNSS seeking to call for the records from the Register of Companies, Chennai, with respect to the respondent company. However, the same came to be dismissed by the impugned order by the learned trial Court. Earlier, the petitioner had filed an application under Section 91 of Cr.P.C., requiring to produce a document by the respondent company. The same was allowed by order 2/7
dated order dated 12.03.2025. Even thereafter, the respondent failed to produce the pertinent document which is necessary to substantiate the petitioner's case. Thereafter left with no other option, since the same record would be available with the Registrar of Companies, Chennai, the petitioner had made an application under Section 243 of Cr.P.C., seeking to call for the record from the Registrar of Companies, Chennai. However, the same came to be dismissed without reference. In the earlier petition, filed by the petitioner under Section 91 Cr.P.C, the following documents were required to be produced by the complainant company and the same are as follows:

4.The annual returns of SYN Agro Products Pvt Ltd in Form No.MGT 7 for 2021-2022 submitted to the Registrar of Companies.
5.The annual returns of SYN Agro Products Pvt Ltd in Form No.AOC-4 XBRL for 2020-2021 submitted to the Registrar of Companies.
6.The annual returns of SYN Agro Products Pvt Ltd in Form No.AOC-4 XBRL for 2021-2022 submitted to the Registrar of Companies.
7.The balance sheets of SYN Agro Products Pvt Ltd for the FY 2020-2021 8.The balance sheets of SYN Agro Products Pvt Ltd for the FY 2021-2022.
3. However, the complainant had preferred to produce only 4 documents. Thereafter, the complainant was also subjected to cross examination, with respect to the documents produced. Since the respondent / complainant failed to produce the remaining documents as required by the petitioner, the petitioner was left with no other option than to file a petition under Section 243 of Cr.P.C. The learned trial Court without considering the same, had passed the impugned order 4/7
recording that the petitioner had produced four documents, dismissed the petition and hence the petitioner sought the indulgence of this Court.
4. Notice to the respondent has been served, but none appeared.
5. A careful perusal of the materials available on record would make it clear that the respondent company has produced only the following documents :
1. The annual returns of SYN Agro Products Pvt Ltd in form No.MGT 7 for 2020 -2021 submitted to the Registrar of Companies.
2. The Annual returns of SYN Agro Products Pvt Ltd in form No.MGT 7 for 2021 - 2022 submitted to the Registrar of Companies.
3. The Balance sheets of SYN Agro Products Pvt Ltd for the FY 2020-2021
4. The Balance sheets of SYN Agro Products Pvt Ltd for the FY 2021 -2022.
The remaining 4 documents were not produced. But without referring to the earlier order passed by the same court, the learned trial Court had dismissed the petitioner's application. In view of the same, the impugned order dated 09.04.2026 passed in Crl.M.P. No. 894 of 2025 in 5/7
S.T.C.No. 22 of 2022, is set aside and the matter is remanded back to the file of learned Judicial Magistrate No.1, Pudukottai, for fresh consideration.
