ORDER : The Court made the following order :- The petitioner/Sole Accused, who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 408, 465, 468, 471 and 420 IPC, in Cr.No.5 of 2022, seeks anticipatory bail.
2.The case of the prosecution is that the de-facto complainant is the owner of the petrol bunk and the petitioner was working as an Accountant in the said petrol bunk. The allegation against the petitioner is that he has swindled a sum of Rs.27,65, 525/- from the defacto complainant's petrol bunk. Hence, the complaint. https://www.mhc.tn.gov.in/judis 1/2
CRL OP(MD). No.12370 of 2022 3.The learned counsel for the petitioner would submit that the petitioner is innocent and he has not committed any offence as alleged by the prosecution. Hence, he prays for anticipatory bail. 4.The learned Additional Public Prosecutor would submit that the petitioner has swindled a sum of Rs.27,65, 525/- from the defacto complainant's petrol bunk and the amount was not yet recovered and the investigation is still pending. Hence, he prayed for dismissal of this petition.
5.The learned counsel for the intervenor vehemently opposed for grant of anticipatory bail to the petitioner. 5.Considering the gravity and nature of the offence and also considering the amount involved in this case is very huge and also the fact that the investigation is still pending, this Court is not inclined to grant anticipatory bail to the petitioner. 6.Accordingly, this Criminal Original Petition is dismissed. sd/- 10/11/2022 / TRUE COPY / /11/2022 Sub-Assistant Registrar (C.S.)
