For Respondent : Mr.M.Sakthi Kumar Government Advocate (Crl.Side) PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- For Anticipatory Bail in Crime No.96 of 2024 on the file of the respondent police ORDER : The Court made the following order :- The petitioner, who apprehends arrest at the hands of the respondent police for the offence under Section 379 IPC r/w 4(1) (1-A) & 21(1) of Mines and Minerals (Development and Regulation) Act, 1957 in Crime No.96 of 2024, on the file 1/3

of the respondent police, seeks anticipatory bail. 2.The case of the prosecution is that the petitioner along with other accused illegally transported 1⁄2 unit of Odai sand in a tractor bearing Reg. No. TN 49 BR 0511. Hence, the complaint.

3.The learned counsel for the petitioner submits that the petitioner is an innocent and he did not commit any offence as alleged by the prosecution. 4.The learned Government Advocate (Crl.side) appearing for the respondent submits that totally thirteen previous cases are pending as against this petitioner, out of which, six cases are of similar in nature. 5.Considering the nature of offence and the antecedents of the petitioner, this Court is not inclined to grant anticipatory bail to the petitioner. Accordingly, this Criminal Original Petition is dismissed.
