PRAYER: Criminal Original Petition is filed under Section 528 of BNSS Act, to call for records pertain to the case in C.C.No.59/2009 on the file of Judicial Magistrate Court No.1, Tirunelveli, and quash the same as illegal. ORDER
The present petition has been filed by the sole accused in C.C.No.59 of 2009, on the file of the learned Judicial Magistrate No.1, Tirunelveli, seeking to quash the charge sheet wherein she is charged with the offence under Section 420 of IPC.
2. According to the learned Counsel appearing for the petitioner, the offence has not been made out and the charge sheet may be quashed. He further submits that all the witnesses have been examined, but only due to the delay in the appearance on the part of the Investigation Officer, the trial could not be completed. In view of long delay for more than 15 years, he seeks to quash the charge sheet.

The learned Counsel for State of TN(crl.side) appearing for the first respondent submits that in view of bifurcation of Tirunelveli District, the case has been transferred to the learned Judicial Magistrate, Tenkasi, and the next date of hearing is fixed at 03.07.2026 and it is yet to be re-numbered.
4. Considering the fact that the case is pending for more than 15 years, the learned Judicial Magistrate, Tenkasi, is directed to dispose of the same on or before 31.08.2026.

5. With the above said observations, this Criminal Original Petition stands disposed of. The personal appearance of the petitioner shall stand dispensed with unless it is specifically directed by the trial Court.
