O R D E R

This writ petition has been filed seeking quashment of the impugned proceedings of the 1st respondent in Letter Ref.No.FC1/321420027/25, dated 26/04/2025 and consequently, direct the 1st respondent to re-issue passport pending in application No.MD1076880102524 within the period that may be stipulated by this court.

2.Heard the learned counsel appearing for the petitioner through VC and the learned Standing Counsel appearing for the 1st respondent as well as the learned Government Advocate (Criminal Side) appearing for the 2nd respondent.

3.By the impugned communication, the petitioner was called upon to report to the Passport Office with all required documents within 10 days, failing which the application filed by the petitioner for issuance of the Passport will be cancelled.

4.The learned Government Advocate (Criminal side) appearing for the 2nd respondent would submit that a case has been registered in Crime No.179 of 2019, dated 18/08/2019 on the file of the 2nd respondent police for the offences under sections 341, 294(b), 323, 324 and 506(2) 2/5

IPC and that charge sheet has been filed on 28/03/2025 and the same was taken on file in CC No.121 of 2025, which has been now pending before the Judicial Magistrate, Paramakudi.

5.Considering the same, there is no scope for issuing a positive direction to the 1st respondent. It is open to the petitioner to approach the concerned Court for appropriate relief. In case, the petitioner is desirous, he may file a fresh application, in case the application has already been closed.

6.With the above said liberty, this writ petition stands disposed of. No costs. Consequently, connected Miscellaneous Petition is closed.
