PRAYER: Criminal Original Petition filed under Section 482 of the Cr.P.C., to issue a direction to the respondents not to harass the petitioner and his family members, under the guise of enquiry.

O R D E R

This Criminal Original Petition has been filed seeking for a direction to the respondents not to harass the petitioner and his family members, under the guise of enquiry.

2. The learned Counsel for the petitioner would submit that there is a dispute between the petitioner and the fifth respondent in respect of ownership of a car whereas the fourth respondent is colluding with the fifth respondent and thereby harassing the petitioner.

3. The learned Additional Public Prosecutor would submit that the petitioner has given a representation on https://hcservices.ecourts.gov.in/hcservices/

15.11.2018 before the fourth respondent. He would further submit based on the representation he has summoned the petitioner for enquiry and that the fourth respondent has not harassed the petitioner, however if the petitioner has any apprehension regarding the fourth respondent a direction may be issued to the Deputy Superintendent of Police, Paramakudi, to conduct investigation and the petitioner may be directed to appear before him for enquiry.

4. The fourth respondent shall handover the file in CSR No.233 of 2018 to the Deputy Superintendent of Police, Paramakudi and the said Deputy Superintendent of Police, Paramakudi is directed to issue summons to both parties and conduct the enquiry in accordance with law and it is further directed that the fourth respondent shall not call the petitioner and petitioner's family members for enquiry. 5.With the above directions, the Criminal Original Petition is closed.
