ORDER

This civil revision petition has been filed to set aside the fair and exorder passed in E.P.No.19 of 2019 in O.S.No.186 of 2012 dated 27.03.2026 on the file of the District Munsif Court, Ottanchandram. 2.Earlier, this Court, vide order dated 29.04.2026, has passed the following order:

"Registry is directed to call for a report from the learned Subordinate Judge at Ottanchathiram as to whether any stay application has been filed by the defendants in A.S.No.58 of 2022. The learned Subordinate Judge shall also send a report as to why the said application has not yet been disposed of. He shall also indicate the time within which the main appeal itself can be disposed.

2. In the meantime, the order passed by the learned District Munsif, Ottanchathiram in E.P.No.19 of 2019 in O.S.No.186 of 2012, dated 27.03.2026, shall be kept in abeyance.

3. Mr.M.C.Swamy shall serve the papers on the respondent as well as on the Counsel, who represented the respondent herein in the Trial Court. In case, notice is not served, Mr.M.C.Swamy runs the risk of the interim stay in this revision being dismissed with cost.

4. Post the case on 05.06.2026 in the admission list. " 3.Pursuant to the above, the learned Subordinate Judge, Oddanchatram, has sent a report dated 04.06.2026 stating that stay application filed under Order 41 Rule 5 has been closed. The said factum was suppressed from this Court and accordingly, by an order dated 05.06.2026, interim stay already granted was vacated. Consequently, C.M.P(MD).No.5845 of 2026 has been dismissed. 4.Thereafter, the matter is listed today (i.e.,12.06.2026). The learned Subordinate Judge, Oddanchatram, is requested to dispose of appeal in 2/4

A.S.No.58 of 2022 within a period of two months from the date of receipt of a copy of this order. No costs.
