For Respondent : Mr.T.Senthilkumar, Government Advocate (Crl.Side) PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- For Anticipatory Bail in Crime No.310 of 2021 on the file of the Respondent Police.

ORDER : The Court made the following order :- The petitioner, who apprehends arrest at the hands of the respondent Police for the offence punishable under Clause 6(4) of TNSC (RDCS) Order 1982, r/w. 7(1)(a)(ii) of Essential Commodities Act, 1955, in Cr.No.310 of 2021, seeks anticipatory bail.

2. The case of the prosecution is that the petitioner has illegally transported 95 bags of PDS rice (each containing 50 Kgs).

3. The learned counsel for the petitioner submits that the petitioner is an innocent and he has been falsely implicated in this case.

4. The learned Government Advocate (Crl. Side) submits that apart from this case, the petitioner is also involved in five other cases, three of which are similar in nature. He further submits that by considering the antecedent of the petitioner, the earlier anticipatory bail petition filed by the petitioner was dismissed by this Court on 22.06.2021 in Crl.O.P.(MD)No.8118 of 2021.

5. But, the learned counsel appearing for the petitioner disputed the same stating that out of five cases, three cases have already been disposed of.

6. Though the learned counsel appearing for the petitioner stated that out of five cases, three cases have already been disposed of, no materials are placed before this Court. Further, there is no change in circumstances of the case. Considering the nature of offence and also the antecedent of the petitioner, this Court is not inclined to grant anticipatory bail to the petitioner.
