PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus directing the third respondent to take steps to hand over the administration of Madurai Parsn Srishti Apartment Owners Association to their office bearers by taking action against the some brokers who have unlawfully captured the office of the Association Building and to hand over the Association office to the petitioner's Madurai Parsn Srishti Apartment Owners 1/4

This Writ Petition has been filed seeking for issuance of a Writ of Mandamus directing the third respondent to take steps to hand over the administration of Madurai Parsn Srishti Apartment Owners Association to their office bearers by taking action against the some brokers who have unlawfully captured the office of the Association Building and to hand over the Association office to the petitioner's Madurai Parsn Srishti Apartment Owners Association on the basis of the petitioner's representation dated 27.06.2022.
2. It is brought to the notice of this Court that the District Registrar, Administration, Madurai North has forwarded a letter vide in Na.Ka.No.818/E1/2018, dated 04.12.2018, declaring the petitioner's earlier Association namely "Parsn Srishti Housing Welfare Society, Registration No.167/1992, as un-functioned Society, on 04.12.2018, as per Section 44(3)(b) of Tamil Nadu Society Registration Act, 1975, 2/4
3. In these circumstances, the third respondent police cannot be directed to take steps to hand over the administration of Madurai Parsn Srishti Apartment Owners Association to the petitioner and there is no merit in this Petition.
