JUDGMENT
(Order of the Court was made by DR.G.JAYACHANDRAN.,J) The Writ Appeal has been filed against the order passed by the learned Single Judge, who has directed the respondents to conduct due enquiry and pass orders on the application made by the Writ Petitioner, for issuance of patta.
2.Heard the learned counsel appearing on either side and perused the materials placed before this Court. 3.The Writ Court, while passing the above mentioned order, had taken note of the fact that there is a title dispute between the Writ Petitioner and one Selvi, who was not a party in the Writ Petition and has issued an order with caveat that issuance of patta shall be subject to the out come of the final decision in A.S.No.21 2/6
of 2024 filed by the said Selvi. While the fact being so, the present appeal is filed by Selvi, after obtaining leave. 4.This Court, after perusing the records, finds that the patta in respect of the disputed property earlier issued and cancelled. Again pursuant to the disposal of O.S.No. 46 of 2014, on the file of District Munsif Court, Peraiyur, Madurai District, initiated by Selvi, the present appellant had sought for grant of patta an subsequently filed a Writ Petition, in which, the learned Single Judge has passed the above order which is now impugned in this Writ Appeal.
5.without adverting to the rival claim made by the parties, We find that the order of the learned Single Judge in the Writ Petition though the appellant herein is not a party, in now way prejudice the right of the appellant, ince the direction is given to conduct enquiry and issue orders for issuance of patta which shall be subject to the outcome of final decision in A.S.NO.21 of 2024. Therefore, it is appropriate for the appellant to participate in the patta proceedings and putforth her case.Hence, there is no necessity for this Court to pursue the appeal filed against the order passed by the learned Single Judge in the above Writ petition.

6.For the aforesaid reasons, the Writ Appeal stands dismissed. No costs. Consequently, connected Miscellaneous Petitions are closed.
