O R D E R
This writ petition has been filed seeking a direction to the respondents to settle the retirement benefits, based on the representation dated 23.08.2017.
2.Heard the learned counsel appearing for the petitioner and the learned Special Government Pleader appearing for the respondents.
3.The learned counsel appearing for the petitioner submitted that the petitioner was earlier dismissed from service, challenging the same, he preferred an appeal. The appellate authority set aside the impugned order of dismissal. Hence, the petitioner is entitled to reinstatement in service. However, he was not reinstated into service as he attained the age of superannuation, but he is entitled to get all the attendant benefits. Seeking such benefits, the petitioner made a representation dated 23.08.2017 and the same is pending without consideration. Therefore, the petitioner is before this Court.
4.The learned Special Government Pleader appearing for the respondents submitted that the representation of the petitioner would be considered on merits.
5.In view of the above, this Court, without going into the merits of the case, directs the respondents to consider the representation of the petitioner dated 23.08.2017, seeking retirement benefits and pass appropriate orders on merits and in accordance with law, within a period of eight weeks from the date of receipt of a copy of this order, after affording an opportunity of hearing to the petitioner.
6.The writ petition is disposed of with the above direction. No costs.
