Respondents PRAYER: Writ Petition filed under Article 226 of Constitution of India, praying for issuance of a Writ of Certiorarified Mandamus, to call for the entire records pertaining to the impugned order passed by the fourth respondent in Ref.No.MDUC HRM 2175 E9 2016, dated 22.06.2016 and quash the same as illegal and arbitrary and further to direct the respondents to appoint the petitioner on compassionate ground as per the petitioner's representation dated 02.04.2016.

By consent of both sides, this writ petition itself is taken up for final disposal.

2.The petitioner has come to this Court seeking Compassionate Ground appointment. But, the petitioner's request was rejected by the respondents on the ground that the petitioner is married and had settled down with her husband. https://hcservices.ecourts.gov.in/hcservices/

3.The benefit of the compassionate ground appointment is only meant for those persons who are living in penury. But, in the present case, the impugned order passed by the fourth respondent would specifically mention that the petitioner has been well settled with her husband. Admittedly, the petitioner's husband is working as a Diploma Engineer in a private firm and they have not produced any Salary Certificate. That itself would clearly show that the petitioner and her husband are not living in poverty. Besides, when the petitioner's husband is a Diploma Engineer and getting handsome monthly salary, she is not entitled to have compassionate appointment. It is meant for those living in object poverty.

4.The Writ Petition stands dismissed, accordingly. No costs.
