PRAYER : Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Certiorarified Mandamus, to call for the impugned order dated 18.02.2025 vide Refusal Check Slip No. RFL/ Vasudevanallur/5/ 2025 as passed by the 4th respondent and subsequently set aside the same as illegal and erroneous and consequently direct him to register the sale deed as presented by the petitioner in respect of the property bearing Survey No. 576/1C situated at Sivagiri Village, Tenkasi District forthwith. ORDER

This writ petition is filed for issuance of Writ of Certiorarified Mandamus, to set aside the impugned order dated 18.02.2025 passed by the 4th respondent and and consequently direct him to register the sale deed as presented by the petitioner in respect of the property bearing Survey No. 576/1C situated at Sivagiri Village, Tenkasi District forthwith.

2. Admittedly, the land in question is Panchami land. The respondents have refused to register the same on the ground that it was classified as Panchami land.

3. It is seen from the records that the petitioner has converted to the Christian religion. In such circumstances, the petitioner cannot maintain the community certificate. Further, the petitioner purchased the land from another person, namely Saratha, who also belongs to the Christian religion. Both cannot claim any special status after converting to another religion.

4. Taking all these reasons into consideration, the impugned order dated 18.02.2025 passed by the 4th respondent is hereby set aside. The 1st respondent/District Collector is directed to conduct an inquiry and pass appropriate orders within a period of four weeks from the date of receipt of a copy of this order.

5. With these directions, this writ petition is disposed of. No costs. Consequently, connected miscellaneous petition is closed. 28.07.2025 NCC : Yes / No Index : Yes / No Internet : Yes Ksa
