Criminal Original Petition filed under Section 482 of Cr.P.C., to direct the 2nd respondent to provide police protection to the petitioner to fence the petitioners land in S.No. 164/2 admeasuring 1 Acre 09 cents now Vard AR, Block 3, T.S.No. 32 situated at Melapalayam Village, Palayamkottai Taluk, Tirunelveli District based on the complaint of the petitioner dated 11.02.2021 and pass such futher or other order.

ORDER

When the matter was taken up for hearing on 31.08.2021, the learned Additional Public Prosecutor submitted that based upon the order passed by this Court, enquiry was undertaken and during the course of enquiry, it was found that it is a civil dispute between the parties, hence, both parties were advised to workout their remedy through civil proceedings. Moreover, the respondent police given an undertaking to the petitioner to the effect that when he intends to measure the property through Government Surveyor and if any trouble arises at that time, the respondent will give protection and the representation of the petitioner came to be closed. For production of the copy of the closure report, the matter has been adjourned today.

CONT P(MD)No.1147 of 2021 2.Today, the respondent police circulated the copy of the closure report and there is no representation for the petitioner. 3.Since the order passed by this Court has been complied with, there is no disobedience on the part of the respondent. Accordingly, this contempt petition is closed. If the petitioner aggrieved by the closure report, it is open to him to challenge the same in the manner known to law.
